As it only has a MAX mesh, not the keyword-listed OBJ and 3DS, I doubt I can use it.

The "non-commercial" license is pretty restrictive in usage. For instance, it's impossible to use this model in a GPL or LGPL licensed game or project, even if the project itself is non-commercial. (It would conflict with the terms of GNU GPL.)
Why not consider releasing under more than one license and allow users to choose the license that fits their more …
